Building and Construction Industry (Security of Payment) Act 2009 (ACT), s 26
Calculate the deadline for lodging an adjudication application with an Authorised Nominating Authority (ANA) under the ACT SOP Act 2009. Three scenarios apply depending on whether a payment schedule was received and whether payment was made.
Scenario 1 — Payment schedule received, scheduled amount less than claimed (s 26(2)(a))
Lodge your adjudication application within 10 ACT business days of receiving the payment schedule.
Scenario 2 — Payment schedule received but amount not paid by due date (s 26(2)(b))
Lodge your adjudication application within 20 ACT business days after the due date for payment.
Scenario 3 — No payment schedule received, amount not paid (s 26(2)(c))
Serve a notice of intention to apply within 20 ACT business days of the due date, then apply within 10 ACT business days after the respondent's 5-business-day schedule period expires.
