Understanding Adjudication Responses
What is an Adjudication Response?
An adjudication response is your formal reply to an adjudication application. It sets out your position on the payment dispute and provides reasons why the claimant's application should be rejected or reduced.
Response Deadline (Section 21(3))
Under the NSW Security of Payment Act, you must lodge your response within 5 business days after the adjudication application is served on you (or 2 business days after receiving notice of an Adjudicator's acceptance of the application, whichever is later). This deadline is strict and cannot be extended.
What Happens if You Miss the Deadline?
If you fail to lodge a response within the 5 business day period, the adjudicator may still make a determination but will only consider the claimant's application. This significantly disadvantages your position.
