Victoria – Adjudication Application Deadline Calculator

Building and Construction Industry Security of Payment Act 2002 (Vic), s 18

Calculate the deadline for lodging an adjudication application with an Authorised Nominating Authority (ANA) under the Victorian SOP Act 2002. The deadline depends on which scenario applies.

Scenario A (s 18(1)): Payment schedule received — 10 Vic business days after receiving the schedule.
Scenario B (s 18(2)): No payment schedule — serve notice within 20 Vic business days of the due date (s 18(2)(a)), then apply within 10 Vic business days after the respondent's 5-business-day schedule period.

Which scenario applies?

Under s 18(1), a claimant may adjudicate whenever the scheduled amount is less than the claimed amount, even if that lower amount has been paid.
