Scenario A — Payment Schedule Received (s 18(1))

Lodge your adjudication application within 10 Vic business days of receiving the payment schedule.

Scenario B — No Payment Schedule Served (s 18(2))

Serve a notice of intention to apply within 20 Vic business days of the payment due date (s 18(2)(a)), then lodge your application within 10 Vic business days after the respondent's 5-business-day schedule period expires.

Adjudication Deadline — Disputed Schedule (s 18(1))

10 Vic business days after receiving the payment schedule

Under s 18(1) of the Vic SOP Act 2002, a claimant may apply for adjudication within 10 Vic business days after receiving a payment schedule where the scheduled amount is less than the claimed amount or remains unpaid. A copy of the application must be served on the respondent within 3 Vic business days of lodging with an ANA (s 19(2)).

Victorian Business Day Rules

Under the Vic SOP Act, a "business day" is any day that is not a Saturday, Sunday, Victorian public holiday, or any day in the period from 22 December to 10 January (inclusive). This is different from NSW, which only excludes 27–31 December.
